Notice Regarding Deadly Weapon Enhancement in Animal Cruelty Cases

The Texas Court of Criminal Appeals has held that the sentencing enhancement for exhibition of a deadly weapon does not apply to the exhibition or use of a deadly weapon against an animal.  Prichard v. State, PD-0712-16, 2017 WL 2791524, at *1 (Tex. Crim. App. June 28, 2017), reh’g denied (Aug. 23, 2017).
